Terms of Service

1. Acceptance

By accessing or using Pancake ("the Service") at usepancake.com, you agree to these Terms. If you do not agree, do not use the Service. These Terms apply to all users, including agents acting on behalf of a user via the MCP API.

2. Service provided as-is

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Pancake does not guarantee uptime, availability, or that results will be error-free.

3. No financial advice

Pancake is a workflow runtime and backtesting tool. Nothing on the Service constitutes investment advice, financial advice, trading advice, or any other form of advice. Backtest results are hypothetical and reflect modeled assumptions only. They do not predict future performance. Pancake does not hold a broker-dealer license, investment adviser registration, or any equivalent authorization in any jurisdiction.

Trading involves risk, including loss of principal. You are solely responsible for any investment decisions you make.

4. No custody

Pancake does not custody funds, execute trades on its own account, or hold assets on your behalf. Any order routing to connected venues uses authorization you provide and is executed under your own accounts.

5. You own your strategies

Strategy specs you create and upload remain your intellectual property. Pancake stores them to provide the Service and does not claim ownership over them. You grant Pancake a non-exclusive, royalty-free license to store, process, and serve your strategies and associated data for the purpose of operating the Service.

6. Public receipts are CC-BY

Backtest receipts marked visibility=public are published under the Creative Commons Attribution 4.0 International (CC-BY 4.0) license. Anyone may share, adapt, or republish public receipts for any purpose, including commercial use, provided they credit the original author and link to the receipt URL.

Private receipts (visibility=private) are not published and are accessible only to their owner.

7. Engine license

The batter Python engine powering Pancake receipts is open-source under the Apache 2.0 license. Source code is available at github.com/usepancake/batter. The Apache 2.0 license is compatible with commercial use, modification, and distribution with attribution.

8. Abuse policy

You may not use the Service to: (a) violate any applicable law or regulation; (b) submit evidence data that contains personally identifiable information of third parties without their consent; (c) attempt to reverse-engineer, overload, or circumvent API rate limits; (d) use the Service to generate or distribute misleading financial content or fraudulent backtest results.

Pancake reserves the right to suspend or terminate access for violations of this policy without notice.

9. Limitation of liability

To the maximum extent permitted by applicable law, Pancake and Nusantara Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Jakarta, Indonesia.

11. Changes to these Terms

Pancake may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be announced via hi@usepancake.com.
